DMV HEARINGS

Have you or a loved been summoned by the Department of Motor Vehicles (DMV) for a hearing?  This type of hearing happens in the Administrative Court at the Department of Safety Bureau of Hearings - not at the the State Circuit Court or Superior Court.  This hearing may be separate or in addition to what is already happening in the Circuit Court or Superior Court.  Depending on the hearing, the potential loss of license can be severe - months, years, in some cases indefinitely.

For example, if you are facing Habitual Offender Certification, per statute RSA 262:19 and 259:39, this type of hearing has a mandatory loss of license for at least one year and maximum and of four years to be determined at the hearing.  If you are facing a Medical Review, per statutes RSA 263:56 and 263:59, you could be suspended indefinitely, unless and until you provide required medical documentation in compliance with the governing administrative rule.

It is important to get legal assistance as soon as you find out about the hearing to be prepared to defend your license.  Did you miss (default) a scheduled hearing?  You may still be able to have your day in court.   Don't delay, in many cases you only have 15 days to to reopen a missed hearing or risk the maximum sentence being imposed.
